Obstacles to climate and environmental justice

On 29 November 2023, Associate Fellow Maud Sarliève was invited to speak to practising lawyers from the Geneva Bar about the obstacles to environmental and climate justice. Her intervention focussed on the most relevant international and regional legal framework, and the most recent developments in case law before the International Court of Justice, the International Tribunal for the law of the Sea, the InterAmerican Court of Human Rights and the European Court of Human Rights. Aside from State responsibility, Maud also briefly discussed the limits of the International Criminal Court and whether or to which extent it might assist in engaging individual criminal responsibility for the most egregious environmental and climate impacts, or the legal vacuum with respect to holding accountable corporate actors most responsible for climate change and environmental destruction.
